Welcome to social-check! These Terms of Service ("Terms") govern your use of our website, AI-powered analysis services, and any related software. By creating an account, using our Service, or accessing our website, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. General terms and conditions

You must be 18 years of age or older to use the Services. To use certain features of the Services, you must register for an account. By registering for an account, you represent and warrant that any information that you submit is true and accurate, that you are 18 years of age or older and are fully able and competent to enter into, and abide by these Terms. You further agree to (i) provide accurate, current and complete information about you as may be prompted by any signup, login and/or registration forms; (ii) maintain the security of your password and identification; (iii) maintain and promptly update the Registration Data, and any other information you provide to us, to keep it accurate, current and complete; (iv) accept all risks of unauthorized access to the Registration Data and any other information you provide to us; and (v) notify us immediately of any unauthorized use of your account or any other breach of security by emailing us at hello@social-check.com. Use of the Services is void where prohibited.

2. Data and Privacy

Public Data Only: We are committed to privacy. Our Service only accesses, collects, and processes data that is publicly available on social media profiles. We do not access private accounts, direct messages, or any non-public information.

User Responsibility: You represent and warrant that you have the necessary rights and permissions to provide the social media profiles for Analysis. You agree not to submit profiles for analysis without proper authorization.

Data Retention and Deletion: To protect the privacy of all individuals, the results of any Analysis you perform are available to you for 24 hours only. After this 24-hour period, the Analysis results are permanently deleted from our servers. We do not store historical analysis data beyond this window.

3. Payment terms

Subscription Options: All users begin with a paid 7-day trial that includes access to our premium features. Trial converts automatically to the subscription plan unless canceled before the trial period ends.

7-Day Trial:

• The first payment of $1.49 activates your trial subscription.
• Trial converts automatically to the selected subscription plan unless canceled before the trial period ends.

Weekly Subscription:

• $9.99/week (USD for U.S. users or equivalent in other currencies based on user location).
• Includes 5 lookups per week (20 lookups per month)
• Billed automatically on a recurring weekly basis after the trial period.

4. Cancellation and Termination

You may cancel your subscription to the Services at any time through one of the following methods:

• By accessing user dashboard and selecting appropriate option “Cancel subscription"
• By contacting our support team at hello@social-check.com
• By submitting a refund request through ourrefund request page

Cancellations take effect at the end of your current billing period. To avoid being charged for the next period, you must cancel before your renewal date. For example, if your weekly subscription renews on January 1, you must cancel on or before December 31 to prevent the charge. You will retain access to the service until your current paid period ends.

If you experience any issues with the cancellation or require further assistance, you may contact our support team via email at hello@social-check.com. When submitting a support ticket, please include your account details and a clear statement requesting cancellation.

Failure to cancel your subscription in accordance with this section may result in continued charges for which you will be responsible.

5. Refunds

Refunds for the $1.49 trial fee are available if requested within 7 days of purchase. For weekly subscription charges ($9.99), we can refund your most recent charge if the request is made within 7 days after the billing date. This reflects our commitment to fair billing practices and understanding that customers may sometimes forget to cancel their subscription.

Refunds may also be provided in specific cases such as service unavailability exceeding 24 hours (excluding scheduled maintenance or force majeure events) or billing errors like duplicate charges or incorrect amounts. Refund requests must be submitted within 30 days of the charge and will be verified by our support team before processing.

6. User Obligations

By accessing or using the SocialCheck Service, you agree to fulfill the obligations outlined below. Your continued access to our Service is contingent upon your strict adherence to these rules.

Lawful and Responsible Use

You agree to use our Service for lawful and ethical purposes only, in full compliance with these Terms and all applicable laws. The Service may not be used for any activity that is malicious, fraudulent, or harmful, including but not limited to stalking, harassment, defamation, or any action that infringes upon the privacy or rights of others. The insights provided by the Service are meant for personal understanding and not for causing harm or distress.

Personal, Non-Commercial Use

The Service, including any Analysis, "match score," or list of "red flags," is provided exclusively for your personal, non-commercial use. You are strictly prohibited from reselling, publishing, distributing, or otherwise commercially exploiting any information generated by the Service without our prior written permission.

Prohibition on Use for Critical Decisions

The data provided by our Service is derived from public social media profiles and is intended for informational and entertainment purposes only. You expressly agree not to use the Service or its Analysis to make significant decisions about any individual, including but not limited to their eligibility for employment, housing, credit, insurance, or for any other purpose governed by regulations like the Fair Credit Reporting Act (FCRA) or similar laws. Such use is a direct violation of these Terms.

Accuracy of Provided Information

You are responsible for providing accurate and current information for your account. Crucially, you are also responsible for ensuring that the social media profiles you submit for Analysis are correct. We are not responsible for results generated from incorrect or erroneously submitted profiles.

7. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, SocialCheck expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

You expressly acknowledge and agree that the Analysis, including any "match score" or "red flags," is generated using data sourced from public profiles via third-party APIs. These third-party data sources are not affiliated with, authorized, or endorsed by the underlying social media platforms, and we do not control and cannot guarantee the accuracy, completeness, timeliness, or reliability of any data provided by them.

Therefore, SocialCheck makes no warranty or representation that the Analysis will be accurate, reliable, or complete. The Service and any information derived from it are intended for informational and entertainment purposes only and are not a substitute for your own judgment or for professional advice. You are solely responsible for any actions you take or decisions you make based on the information provided by the Service.

8. Limitation of Liability

SOCIALCHECK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES AND AGENTS ASSUME NO LIABILITY OR RESPONSIBILITY FOR, AND IN NO EVENT, INCLUDING NEGLIGENCE, SHALL SOCIALCHECK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES OR AGENTS, BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM, ANY:

1. PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SITE, THE SERVICES, THE SITE MATERIALS OR ANY USER CONTENT;
2. UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN;
3. INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SITE;
4. BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE SITE, OR SITES LINKED TO BY THIS SITE, BY ANY THIRD PARTY; AND/OR
5. ERRORS OR OMISSIONS IN ANY CONTENT MADE AVAILABLE BY SOCIALCHECK OR ITS USERS, OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED OR OTHERWISE MADE AVAILABLE VIA THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT SOCIALCHECK IS OR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. IN NO EVENT SHALL SOCIALCHECK’S AGGREGATE LIABILITY EXCEED $100.00. THIS ALLOCATION OF RISK UNDER THESE TERMS IS AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN THE PARTIES. EACH OF THESE PROVISIONS SHALL BE SEVERABLE AND INDEPENDENT OF ALL OTHER PROVISIONS SET FORTH IN THESE TERMS. THE LIMITATIONS IN THIS SECTION SHALL APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

9. Age limit

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to create an account and use our Service. By using the Service, you represent and warrant that you meet this age requirement. This Service is not intended for use by children.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such change constitutes your acceptance of the new Terms.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.
